Terms of service

These terms are an agreement between you and Simorq LLC ("Simorq", "we") for your use of the Simorq app and related services. By using Simorq you accept these terms. If you do not accept them, do not use Simorq. The privacy notice explains how we handle personal data.

Eligibility and licence

You must be at least 18 years old, and old enough to form a binding contract where you live, to use Simorq. We grant you a personal, non-exclusive, non-transferable and revocable licence to use the app for lawful purposes in line with these terms. Parts of Simorq are provided under open-source licences; those licences govern those parts, and nothing in these terms limits your rights under them.

Acceptable use

You must not use Simorq to break the law; to harm, harass or threaten others; to post another person's private information without their permission; to send spam or malicious code; or to interfere with, or try to gain unauthorised access to, our services or other people's devices.

Your content and the Nest

Reports you send to the Nest are public: nearby phones receive them, and others can keep and forward them. You are responsible for what you post. You keep any rights you have in your content. By sending a report, you grant Simorq LLC a worldwide, non-exclusive, royalty-free licence to store, copy, process and display it as needed to operate the Nest and as described in the privacy notice. If you break these terms or the Nest rules, we may warn you, suspend uploads from your phone to us and block your phone across the Nest, so that other phones hide its reports and stop passing them on.

AI output

The assistant's answers are generated on your phone by AI models and can be inaccurate, incomplete or out of date. Nest reports come from other people and can also be wrong. Do not rely on either as professional advice, such as medical, legal or financial advice, or in place of emergency services.

Third-party models

AI models and other content you choose to download are provided by third parties under their own licences and terms, which you must follow. We do not control them and are not responsible for them.

Disclaimer of warranties

To the fullest extent permitted by law, Simorq is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that Simorq will be uninterrupted, error-free or available where you are.

Limitation of liability

To the fullest extent permitted by law, Simorq LLC is not liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of Simorq. Our total liability for all claims relating to Simorq is limited to 100 US dollars. Nothing in these terms excludes or limits liability that cannot be excluded or limited by law, including your rights as a consumer under the mandatory law of the country where you live.

Termination

You may stop using Simorq at any time and delete your data in the Me tab. We may suspend or end your access if you breach these terms or where the law requires it. Provisions that by their nature should continue after termination will continue.

Governing law

These terms are governed by the laws of the State of California, USA, and disputes relating to them are subject to the courts located in California. If you are a consumer in the European Union, you also keep the protection of the mandatory law of your country of residence and may bring proceedings in its courts.

Changes and contact
